When we meet with our elder clients and their families, we do a complete assessment of all existing financial assets, income, and past transfers, along with a family history, needs, and goals.  We review any existing estate plan documents, and often we will suggest that they be redone to reflect recent changes and requirements in the law.

Because of the tremendous burden of long-term nursing home care, it is important for elders to plan for their long-term care needs.  We carefully review all of the options that are available, along with the advantages and disadvantages of each approach.  We explore whether any of the following are available and make sense in light of the client's goals and needs and current law:  Medicaid trust or other irrevocable trusts, caretaker child exception, personal care contract, life estates and other transfers of real estate interests, disability exceptions, and possible veterans benefits.

We strongly encourage clients to develop a estate plan with an attorney specializing in elder law, preferably well in advance of the need for nursing home care when more options may be available.
